A Queenstown family have won a battle to prove that their Swedish au pair's claims of being "dumped" at an airport in Samoa with $20 for "wrecking their holiday" did not stack up.Amanda Akeson went to the Employment Relations Authority last year, claiming she had been left at Samoa's airport by Janine and Hamish Learmonth to "fend for herself" with only $20.
The Learmonths claimed the nanny refused to work once they arrived at their Pacific resort, when she should have been looking after their children.
The ERA ruled in her favour and ordered her employers, Janine and Hamish Learmonth, to pay her $1189.99 in unpaid wages and holiday pay.
But the Learmonths challenged the decision as they had not had a chance to properly argue their case - and yesterday the ERA reversed its decision. However, the au pair returned to Sweden while the appeal was being heard.
ERA member James Crichton said it had made an error, "which it regretted", by issuing its finding before the Learmonths had filed all their submissions.
The ERA found Mrs Learmonth had taken Ms Akeson to the airport in Samoa, arranged her flight home, stayed with her for up to an hour and left her with $90.
"The authority must again vacate its original conclusion ... and substitute it with a fresh conclusion that, whatever happened when Ms Akeson commenced to leave Samoa for New Zealand, no criticism can be levelled at the Learmonths, based on the evidence now before the authority," the decision said.
Mrs Learmonth said she was "over the moon" with the result.

KABUL, Afghanistan (AP) ? A military official says Muslim holy books that were burned in a pile of garbage at a U.S. military base in Afghanistan had been removed from a library at a nearby detention center because they contained extremist messages or inscriptions.
A military official with knowledge of the incident told The Associated Press on Tuesday that it appeared the Qurans and other Islamic readings were being used to fuel extremism, and that detainees apparently were leaving notes for one another inside them.
The official, who did not want his nationality disclosed, spoke on condition of anonymity because he was not authorized to discuss the incident.
The top commander of U.S. and NATO forces in Afghanistan says the books were inadvertently given to troops for burning.

KABUL, Afghanistan (AP) ? More than 2,000 angry Afghans protested outside an American air base on Tuesday after they learned that copies of the Quran, the Muslim holy book, were burned in a pile of garbage at a sprawling U.S. military base north of Kabul.
"Die, die, foreigners!" the demonstrators shouted. Some fired rifles into the air. Others threw rocks at the gate of the base and set tires ablaze.
The burning of the Quran and other religious books was unintentional, said U.S. Gen. John Allen, the top commander of American and NATO forces in Afghanistan.
The incident stoked anti-foreign sentiment that already is on the rise after a decade of war in Afghanistan and fueled the arguments of Afghans who claim foreign troops are not respectful of their culture or Islamic religion.
Early Tuesday, as word of the incident spread, about 100 demonstrators gathered outside the sprawling Bagram Air Field in Parwan province. As the crowd grew, so did the outrage.
One protester, Mohammad Hakim, said if U.S. forces can't bring peace to Afghanistan, they should go home.
"They should leave Afghanistan rather than disrespecting our religion, our faith," Hakim said. "They have to leave and if next time they disrespect our religion, we will defend our holy Quran, religion and faith until the last drop of blood has left in our body."
Ahmad Zaki Zahed, chief of the provincial council, said U.S. military officials took him to a burn pit on the base where 60 to 70 books, including Qurans, were recovered. The books were used by detainees once incarcerated at the base, he said.
"Some were all burned. Some were half-burned," Zahed said, adding that he did not know exactly how many Qurans had been burned.
Zahed said five Afghans working at the pit told him that the religious books were in the garbage that two soldiers with the U.S.-led coalition transported to the pit in a truck late Monday night. When they realized the books were in the trash, the laborers quickly worked to recover them, he said.
"The laborers there showed me how their fingers were burned when they took the books out of the fire," he said.
In a statement, Allen said he had ordered an investigation and offered his apologies to the president and people of Afghanistan. He thanked local Afghan workers "who helped us identify the error, and who worked with us to immediately take corrective action."
"We are thoroughly investigating the incident and are taking steps to ensure this does not ever happen again," Allen said. "I assure you, I promise you, this was not intentional in any way."
Afghan Army Gen. Abdul Jalil Rahimi, the commander of a military coordination office in the province, said he and other officials met with protesters, tribal elders and clerics to try to calm their emotional response. "The protesters were very angry and didn't want to end their protest," he said.
Later, however, the protesters ended the rally and said they would send 20 representatives from the group to Kabul to talk with Afghan parliamentarians and demanded a meeting with President Hamid Karzai, Rahimi said.
The governor's office in Kandahar province in southern Afghanistan called the incident a "shameful move by some stupid individuals."
Zia Ul Rahman, deputy provincial police chief, said between 2,000 and 2,500 protesters demonstrated at the base.
"The people are very angry. The mood is very negative," Rahman said while the rally was going on. "Some are firing hunting guns in the air, but there have been no casualties."
Police said a similar protest on Tuesday just east of Kabul ended peacefully.
In April 2011, Afghans protesting the burning of a Quran by a Florida pastor turned deadly when gunmen in the crowd stormed a U.N. compound in the northern city of Mazar-e-Sharif and killed three staffers and four Nepalese guards.
Separately, officials in Helmand province in the south said insurgents beheaded four people Sunday night in Washer district on the charge that they were spies.
"The militants told the local people that they were guilty because they were carrying satellite phones," provincial spokesman Daoud Ahmadi said.
Taliban spokesman Qari Yousef Ahmadi said that the militant group was not involved in the killings.
Also in the south, a NATO service member died Tuesday as a result of a non-battle related injury. The U.S. led coalition gave no further details about the death. So far this year, 44 NATO service members have been killed in Afghanistan.

On Friday, Biden and Xi start with a China trade forum in downtown Los Angeles, followed by a luncheon and school visit to meet children learning Mandarin. They'll end the day with a governor's forum at Disney Hall.
Xi's U.S. tour comes at a politically challenging time in U.S.-China relations, with the White House sending stern messages on currency and trade policies and Republican presidential candidates claiming President Barack Obama isn't doing enough to keep America competitive with the Chinese economy.
The Asian power sells four times as many goods to the U.S. as the United States sends in return to China. The U.S. shipped $13.5 billion in exports to China through the Los Angeles port last year.
In a carefully scripted event, Xi took a short walking tour through the China Shipping terminal with Brown and Mayor Antonio Villaraigosa. The facility sprawls over nearly 100 acres.
"We're not just growing our ports, but we're greening our ports," Villaraigosa told Xi.
"When I heard that this is an environmentally friendly green port, I felt that this was a major achievement," Xi later told a crowd in a brief statement after his stroll with Villaraigosa.
"This is a solid foundation for future U.S.-China trade and economic cooperation," he said.
As with his previous travels, Xi was focusing on forging relationships.
Xi spent the morning Thursday in Iowa, where officials from the U.S. and China signed a five-year deal to guide discussions on food security, food safety and sustainable agriculture.
China became the top market for U.S. agricultural goods last year, purchasing $20 billion in U.S. agricultural exports, according to the U.S. Department of Agriculture.
Much of Xi's visit, which began earlier this week in Washington, D.C., has been focused on agriculture. The strategic cooperation agreement signed Thursday outlines mutual goals and responsibilities of each nation.
"It charts the course and gives us a guiding document that we can reference and, over time, refine and improve," said Scott Sindelar, the agricultural minister counselor at the U.S. embassy in Beijing, who attended the Des Moines conference.
According to the USDA, the value of U.S. farm exports to China supported more than 160,000 American jobs last year across a variety of business sectors.
U.S. Secretary of Agriculture Tom Vilsack said the two nations will have to work together to help feed a growing global population.
"We have the responsibility and opportunity to work together to address the causes of global hunger that effect more than 925 million people. Current populations trends mean that we must increase agricultural production by 70 percent in the year 2050 to feed nearly 9 billion people," he said.
Not everyone celebrated the vice president's arrival. The California Fair Trade Coalition, a San Francisco-based nonprofit that supports expanding trade while promoting economic justice, issued a statement calling on Brown to "address China's predatory trade practices."

Both people spoke to The Associated Press on Tuesday on the condition of anonymity because the negotiations are considered to be confidential, despite repeated leaks about the discussions during the past few months.

For now, though, investors are disillusioned with Yahoo's inability to close the deal on the Asian assets. The company's shares shed 76 cents, or 4.7 percent, to close at $15.36 ? below their price six weeks ago when Yahoo announced Thompson's hiring.
The Asian impasse comes as a surprise, given that Yahoo and the prospective buyers, Alibaba and Yahoo Japan shareholder Softbank Corp., all seemed motivated to seal a long-awaited deal. Yahoo was confident enough to dispatch negotiators to Hong Kong last week while Alibaba had been seeking financing to pay for its part, one person said.
But the sides couldn't agree on the value of Yahoo's holdings, which have been steadily rising in the past few years as Alibaba's electronic-commerce services prospered in China's rapidly growing Internet market. Analysts have also differed on how much Yahoo could fetch by selling its stakes, with estimates ranging from $11 billion to $18 billion.
To compound the challenges, the deal was arranged in a way that would have enabled Yahoo to avoid paying taxes. That proposal, according to both people who spoke to the AP, was structured a "cash-rich split-off" that would have resulted in Alibaba and Softbank contributing money and other assets into a special entity in exchange for Yahoo's stakes in the Asian companies. Yahoo then could have used the money generated from the Asian sale to placate its long-frustrated shareholders with a special dividend or other measures that might reverse a three-year slump in its net revenue.
The downturn has turned Yahoo's Asian stakes into the most valuable part of the company, even though its own operations still include websites boasting an audience of about 700 million people.
But Yahoo is having trouble attracting the advertisers who have been spending more money on the Internet in recent years, a trend that has been enriching online search leader Google Inc. and Facebook, the owner of the largest online social network.
Yahoo remains open to reviving the negotiations to sell its Asian assets at the right price, one of the people familiar with the matter said. That could include a new proposal that would taxable in the U.S., the other person said.
When Yahoo appeared reluctant to sell its Asian stakes late last year, investment firms Blackstone Group and Bain Capital considered teaming up with Alibaba and Softbank in a joint bid to buy Yahoo in its entirety, according to media reports that cited unnamed people.
